Is it worse to pay someone to beat up another person or be the person receiving payment for doing the deed?

A friend is arguing with me. He says that its not a bad offense if you are doing so in retaliation or if you are paying a person to do so in retaliation. "I think he is being stupid and either one or both would go to jail."
